**Terms and Conditions of Sale and Use**

These Terms and Conditions (“Terms”) govern your purchase of products from and use of the website operated by **HiTec Arms** (“HTA,” “we,” “us,” or “our”) at https://hitecarms.com (the “Website”). By accessing the Website, placing an order, or purchasing any products, you agree to be bound by these Terms. If you do not agree, do not use the Website or place any orders.

HTA reserves the right to update these Terms at any time. Your continued use of the Website or placement of orders after any changes constitutes your acceptance of the revised Terms.

### 1. Customer Service and Pre-Purchase Advice
Customer service is a priority at HiTec Arms. If you are not satisfied with your order, we will do our best to correct the situation to your satisfaction. **Because of the significant costs involved with returning products, especially firearms and regulated items, it is always best to contact us with any questions you may have about our products before you place an order.**

### 2. Products, Sales, and Regulatory Compliance
HTA sells new and used firearms, firearm parts, components, accessories, ammunition, optics, and related products. All sales are strictly subject to applicable federal, state, and local laws, including the Gun Control Act, National Firearms Act (where applicable), and ATF regulations.

– **Firearms and Regulated Items**: All firearms and items requiring transfer will **only** be shipped to a valid Federal Firearms Licensee (FFL) in the United States. You are solely responsible for arranging transfer through a licensed FFL dealer, completing all required paperwork (including ATF Form 4473), passing any background check, paying any FFL transfer fees, and complying with all age, residency, permitting, and legal requirements in your jurisdiction. HTA does not ship firearms or regulated items directly to consumers.
– **Non-Firearm Accessories and Parts**: These may ship directly, subject to all applicable laws.

We reserve the right to refuse or cancel any order at our sole discretion, including for suspected fraud, legal non-compliance, or product unavailability.

**Sezzle Purchases**: ALL PURCHASES MADE THROUGH SEZZLE ARE FINAL. THERE WILL BE NO RETURNS ALLOWED.

### 3. Warranties
All products are new (unless expressly sold as used) and covered under the **Manufacturer’s warranty**. Product defects must be handled by contacting the manufacturer directly (whether that is HTA or another manufacturer). HTA provides no independent warranty beyond what the manufacturer expressly offers.

### 4. Product Images, Descriptions, and Substitutions
Product images are for illustrative purposes only and may not always reflect the exact item, packaging, branding, color, or components received. HTA reserves the right to **substitute parts or components** as needed due to product availability, manufacturing changes, or supply chain limitations. Any substitutions will be of equal or comparable quality and intended to meet the same function and performance standards.

For **used firearms**: Photos on the Website are of the actual firearm for sale. Used firearms are sold **as-is** and may show normal signs of wear and cosmetic blemishes. We cannot accommodate special requests for additional photographs. The product description lists all included accessories.

### 5. Pricing, Payment, Shipping, and Risk of Loss
Prices are subject to change without notice and do not include shipping, handling, taxes, or FFL fees. You are responsible for all applicable taxes and FFL transfer fees. Risk of loss passes to you upon tender to the carrier. Shipping times are estimates only.

### 6. Return and Refund Policy (RMA Process)
**No returns will be accepted without prior approval** from HiTec Arms. To initiate a return, contact us via email (info@hitecarms.com) or phone (850-810-4004) to obtain a **Return Merchandise Authorization (RMA) number**. We will provide an RMA form with detailed shipping instructions. **No returns will be accepted without a valid RMA number** clearly written on the outside of the packaging or original receipt.

– All returns must be made **within 30 days of product delivery**.
– A **20% restocking fee** will be charged on all approved returns (unless exchanged for an item of equal or greater value).
– All returns must be **new, unused, unmounted/uninstalled**, in the **original packaging**, and include all accessories, documentation, and registration cards. Items must be in resalable condition.
– Use the **original shipping box** in which your order was shipped. Do not ship in only the manufacturer’s box.
– You are responsible for all **return shipping charges and insurance**. Shipping charges for product returns are non-refundable.
– If your carrier loses or damages the return package, contact the carrier directly.

**Firearms**:
– Once a firearm has been transferred to you through a completed ATF Form 4473 at the receiving FFL, **no refunds or returns will be issued**. By proceeding with the transfer, you acknowledge and accept the firearm **as-is**, with no exceptions.
– **Cancellations** of firearms incur a 20% restocking fee unless exchanged for an item of equal or greater value. Engraving fees and NFA transfer taxes/fees are non-refundable.
– **No returns** will be accepted for firearms after transfer from the dealer to the buyer (whether purchased online and transferred to an FFL or at a HiTec Arms retail location, if applicable). Firearms cannot be returned unless found defective or damaged upon inspection **at the dealer** prior to completing paperwork. Inspect your firearm thoroughly and refuse the transfer if you are not satisfied. After transfer into your possession, any warranty issues must be addressed directly with the firearm manufacturer.
– Any firearms left unclaimed for more than **180 days** will be considered abandoned and may be resold.

**Accessories**:
All returned or exchanged accessories must be in new (unmounted/uninstalled), resalable condition with original packaging. Returns must include the original receipt and will incur a 20% restocking fee unless exchanged for an item of equal or greater value.

**Used Firearms, Ammunition, Optics, Flashlights, Barrels, Barreled Receivers, Tools**:
**Absolutely NO RETURNS**. All sales are final. No exceptions.

**Service / Gunsmithing**:
All services are subject to fees according to our current fee schedule, collected in advance. Gunsmithing items left for more than **180 days** will be considered abandoned and may be auctioned or otherwise disposed of.

**Defective Products**:
For manufacturer defects, contact the manufacturer directly. HTA may assist on a case-by-case basis but makes no guarantees.

### 7. Limitation of Liability and Disclaimer of Warranties
To the maximum extent permitted by law, HTA disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Products are provided “AS IS” except for the manufacturer’s limited warranty (if any).

HTA shall not be liable for any indirect, consequential, incidental, special, or punitive damages. Our total liability for any claim shall not exceed the amount you paid for the specific product. You assume all risk associated with the safe handling, storage, transport, and use of firearms and related products. You agree to indemnify, defend, and hold HTA harmless from any claims, losses, or liabilities arising from your misuse, illegal use, or violation of law.

### 8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws rules. Any disputes shall be resolved exclusively in the state or federal courts located in Dallas County, Texas. The prevailing party in any litigation shall be entitled to recover its reasonable attorney’s fees and costs.

### 9. Miscellaneous
These Terms constitute the entire agreement. If any provision is invalid, the remainder remains enforceable. Our failure to enforce any right does not waive it. We may assign our rights; you may not assign yours without consent.
